Job Description

In-House Counsel

Reporting to the General Counsel, Corporate Secretary, and SVP Human Resources, the Corporate Counsel will provide comprehensive legal guidance to management and their teams on a broad range of legal, business, and strategic issues. In this role, you will have frequent contact with all levels of Tuesday Morning leadership, legal department colleagues, as well as outside partners and vendors. You will collaborate with subject matter experts and support the business by working through critically important and complex legal issues in a rapidly-evolving environment. Corporate Counsel will be primarily responsible for handling labor and employment-related matters and litigation, providing advice and counsel on all matters related to labor & employment matters, legal review of all contracts and providing counsel to business teams on contract-related issues as well as assisting on a variety of other legal matters within the legal department as projects/needs arise

Primary Responsibilities:

  • Advise, counsel, and support in labor and employment-related matters for the organization
  • Managing outside litigation and regulatory matters, including directing outside counsel, coordinating responses and discovery requests, oversight of litigation pleadings, motions, and briefs prepared by outside or internal counsel, etc.
  • Working closely with Tuesday Morning Human Resources Partners across the organization to accomplish the company’s strategic objectives while minimizing risk by providing advice and strategic support to HR Business Partners and business leaders on performance management, investigations, accommodations, reorganizations, agency charges, and other employment-related matters.
  • Collaborating with executives, internal business clients and legal department colleagues on a variety of legal matters.
  • Draft, review, and negotiate a wide variety of contracts for internal business units including, services agreements, license agreements, engagement letters, management services, employment agreements and consulting agreements.
  • Investigating and responding to administrative/regulatory inquiries and charges.
  • Partnering with outside counsel on various legal matter including litigation management, and attending mediations, and trials and assist in formulating early resolution strategies.
  • Participate in formulation, implementation, interpretation, and training of company and department policies.
  • Maintain current knowledge of the law in matters of interest to company
  • PERFORMS OTHER RELATED DUTIES AND ASSIGNMENTS AS REQUIRED.

Education:

Law degree from an accredited law school and an active license to practice law in Texas

 Certifications or Licenses:

License to practice law and in good standing under the Bar of the state of Texas.

 Required Skills/ Experience:

  • 5+ years of experience in labor and employment counseling and/or mediation, arbitration and litigation, and drafting, reviewing and negotiating contracts
  • At least two years in-house experience
  • This position requires in-depth knowledge of labor and employment laws including  anti-discrimination/harassment/retaliation laws, leave of absence and accommodation obligations, and wage and hour statutes and regulations
  • Familiarity with California employment law.
  • Experience in consumer goods/retail/brand industries preferred
  • Must have strong organizational skills, excellent verbal and written communication skills
  • Must be able and willing to work under time-sensitive deadlines and be productive in fast-paced environments with multiple competing priorities.
  • Ability to evaluate legal risks and provide practical business-oriented solutions.

  • Ability to devise legal solutions that reduce financial liability, costs and negative publicity to acceptable levels.

  • Knowledge of and ability to analyze the effect of company policies on business activities.
  • Proven experience interacting with all levels of corporate management
